Preamble

These general terms and conditions of sale (the "Terms") apply to any order placed on the website angelnomad.com (the "Site").

The Site is published and operated by BROD'STYL INTERNATIONAL, a French simplified joint-stock company (société par actions simplifiée) with share capital of €8,304.00, registered with the Paris Trade and Companies Register (RCS) under number 421 258 724, whose registered office is at 41 rue du Caire, 75002 Paris, France, intra-EU VAT number FR44 421258724 (hereinafter "Angel Nomad" or "we").

Contact: contact@angelnomad.com · 01 41 33 41 55 (standard call rate) · 41 rue du Caire, 75002 Paris, France.

Article 1: Definitions

In these Terms:

  • "Customer": any natural person of legal age who purchases on the Site for their personal needs, outside of any commercial, industrial, craft, liberal or agricultural activity;
  • "Products": the items offered for sale on the Site;
  • "Order": the purchase of one or more Products confirmed by the Customer on the Site;
  • "Account": the personal area that the Customer may create on the Site;
  • "Working Days": Monday to Friday, excluding public holidays in France.

Article 2: Purpose, acceptance and amendment of the Terms

2.1. These Terms set out the rights and obligations of Angel Nomad and the Customer for any sale of Products on the Site. They prevail over any other document, unless otherwise agreed in writing.

2.2. The Customer declares that they have read and accepted these Terms before placing an order. Confirmation of the Order constitutes acceptance of these Terms. They are accessible at any time on the Site and may be downloaded and printed.

2.3. Angel Nomad may amend these Terms at any time. The Terms applicable to an Order are those online on the date on which it is confirmed.

2.4. All Products are sold by Brod'Styl International, the sole seller on the Site. The Site is intended for private individuals only. Professionals wishing to purchase for resale must contact us beforehand.

2.5. These Terms are drafted in French. They may be translated into other languages for ease of reading; in the event of any discrepancy, the French version shall prevail, subject to any more favourable provisions for the Customer under the law of their country of residence.

Article 3: Customer account

3.1. The Customer may order without creating an Account. They may also create an Account to track their Orders and save their addresses.

3.2. The Customer undertakes to provide accurate information and to keep it up to date. They are responsible for the confidentiality of their login credentials and for any use of their Account. In the event of unauthorised use, they shall inform customer service without delay.

3.3. Angel Nomad may suspend an Account in the event of proven fraud or serious breach of these Terms, after informing the Customer, without prejudice to Orders in progress.

Article 4: Products

4.1. Angel Nomad offers Products from several brands. The essential characteristics of each Product (description, composition or material where known, size or dimensions, brand, price, care instructions where applicable) are shown on its product page. The Customer is invited to read them, as well as the size guide where one exists, before ordering.

4.2. Photographs are as faithful as possible. Colours may, however, vary slightly depending on the screen used.

4.3. Products are offered while stocks last. If a Product becomes unavailable after the Order, the Customer is informed by e-mail and refunded the sums paid for that Product, without delay and no later than 14 days after payment. The rest of the Order is shipped, unless the Customer prefers to cancel it in full.

4.4. Some Products may benefit from a commercial guarantee specific to their brand. Its terms are then indicated on the Product page; it is in addition to, and does not replace, the legal guarantees set out in Article 11.

Article 5: Prices

5.1. Prices are shown in euros, inclusive of all taxes (French VAT or, for delivery to another European Union country, the VAT of that country in accordance with distance selling rules). They do not include delivery charges, which are indicated before the Order is confirmed.

5.2. Prices may be changed at any time. The price invoiced is the one displayed when the Order is confirmed.

5.3. Price reductions. Where a struck-through price or a percentage reduction is displayed, the reference price is the lowest price charged by Angel Nomad for that Product during the 30 days preceding the application of the reduction (Article L112-1-1 of the French Consumer Code).

5.4. Obvious pricing error. In the event of an obvious clerical error in a price (for example, a derisory price bearing no relation to the value of the Product), Angel Nomad may cancel the Order concerned. The Customer is informed and refunded in full without delay.

5.5. Deliveries outside the European Union. For deliveries outside the European Union, the delivery charges include a flat fee of €25 covering customs duties and import taxes, which are paid by Angel Nomad. No additional amount is requested from the Customer on delivery.

Article 6: Promotional offers, discount codes and gift cards

6.1. Promotional offers are valid for their stated duration and while stocks last, under the conditions indicated on the Site or on the medium of the offer.

6.2. Unless otherwise stated, discount codes cannot be combined with one another, may be used only once per Customer, do not apply to the purchase of gift cards or to delivery charges, and cannot be exchanged for cash. If a Product purchased with a code is returned, the refund covers the price actually paid.

6.3. Gift cards are valid without time limit, unless an expiry date is indicated when they are purchased. They may be used on the Site, in one or more transactions, up to the amount of their balance.

6.4. Gift cards are neither refundable nor exchangeable for cash, unless otherwise provided by law. Their purchase is subject to the right of withdrawal for as long as they have not been used. Angel Nomad is not responsible for the loss of a card, or for its use by a third party, where its code has been disclosed.

Article 7: Orders

7.1. To order, the Customer selects the Products, checks the contents of their basket, enters their contact details and delivery address, and chooses the delivery method and payment method. They may check and correct each piece of information before confirming.

7.2. The Order is placed when the Customer clicks on the confirmation button, which states the obligation to pay. The contract is formed upon confirmation of payment.

7.3. Angel Nomad confirms the Order by an e-mail summarising the Products, prices, delivery charges and delivery address, with a link to these Terms. The Customer is invited to check their spam folder if they do not receive it.

7.4. Angel Nomad may refuse or cancel an Order in the event of an unresolved prior dispute with the Customer, refused payment, serious suspicion of fraud, or quantities clearly intended for resale. The Customer is informed and, where applicable, refunded.

7.5. An invoice is sent to the Customer on simple request to customer service.

Article 8: Payment

8.1. The price is payable in full, online, at the time of the Order, by the means offered on the payment page, in particular bank card and digital wallets such as Apple Pay and Shop Pay.

8.2. Payments are processed by secure providers (including Shopify Payments), with strong cardholder authentication (3D Secure) where required by the bank. Angel Nomad never has access to the Customer's full bank card details and does not store them.

8.3. Angel Nomad and its providers carry out checks to combat fraud. An Order may be put on hold while a verification is carried out; the Customer may then be asked to provide supporting documentation.

8.4. If payment is refused or fails, the Order is not processed.

Article 9: Delivery

9.1. Areas and rates. Products are delivered to the countries offered when the Order is placed. Delivery methods, rates, free delivery thresholds and indicative lead times are detailed in the Delivery Policy and restated before the Order is confirmed.

9.2. Lead time. The lead times indicated run from dispatch. Unless a shorter lead time is indicated when the Order is placed, Products are delivered no later than 30 days after the conclusion of the contract. In the event of delay, the Customer may ask Angel Nomad to deliver within a reasonable additional period; failing delivery within that period, they may terminate the contract and be refunded all sums paid (Articles L216-1 et seq. of the French Consumer Code).

9.3. Tracking. An e-mail with the tracking number is sent to the Customer upon dispatch.

9.4. Address. The Customer is responsible for the accuracy of the delivery address and their contact details. If a parcel is returned to Angel Nomad because of an incorrect or incomplete address, or because it was not collected from a pick-up point within the time allowed, Angel Nomad will contact the Customer to either reship it, with new delivery charges payable by the Customer, or refund the price of the Products.

9.5. Receipt. The Customer is invited to check their parcel upon receipt and to report any anomaly (damaged parcel, missing or damaged Product) to customer service as soon as possible, with photos if possible, and to record reservations with the carrier where possible. This report facilitates handling but is not a condition of the legal guarantees.

9.6. Loss or damage. The risk of loss of or damage to the Products passes to the Customer when they, or a third party designated by them, take physical possession of the Products. Until that time, in the event of loss or damage during transport, Angel Nomad reships the Products, subject to availability, or refunds the Customer.

Article 10: Right of withdrawal

10.1. Period. The Customer has 14 days to withdraw, without having to give reasons or pay any penalty. The period runs from the receipt of the Product by the Customer or by a third party designated by them. For an Order of several Products delivered separately, it runs from the receipt of the last Product. Where the period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.

10.2. How to withdraw. The Customer informs Angel Nomad of their decision before the period expires:

  • online, via the Site's contact form, stating "Withdrawal", the Order number and the Products concerned;
  • by e-mail to contact@angelnomad.com;
  • or by post, using the form set out in the appendix or any other unambiguous statement.

Angel Nomad acknowledges receipt of the withdrawal without delay, by e-mail. Simply returning the parcel without a statement does not always make it possible to identify the Order: it is recommended to write to us first.

10.3. No exchanges. Angel Nomad does not offer exchanges: to obtain another size or another Product, the Customer returns the item for a refund and places a new Order.

10.4. Return of Products. The Customer returns the Products no later than 14 days after communicating their decision, to the following address: BROD'STYL INTERNATIONAL, Service Retours Angel Nomad, 41 rue du Caire, 75002 Paris, France. Return costs are borne by the Customer, whatever the destination. It is recommended to use a tracked service and to keep proof of postage: the Customer bears the risk of return transport. For a return from a country outside the European Union, any duties and taxes relating to the return remain payable by the Customer.

10.5. Condition of Products. The Customer may handle and try on the Product as they would in a shop. They are liable only for any diminished value of the Product resulting from handling other than what is necessary to establish its nature, characteristics and functioning (Article L221-23 of the French Consumer Code): for example, an item worn beyond a try-on, washed, stained, damaged or incomplete. In that case, Angel Nomad may deduct the amount of this diminished value from the refund and informs the Customer accordingly. It is recommended to return the Products with their labels and in their packaging.

10.6. Refund. Angel Nomad refunds all sums paid, including the initial delivery charges at the standard delivery rate, no later than 14 days after being informed of the withdrawal. Angel Nomad may withhold the refund until it has received the Products or until the Customer has supplied proof of having sent them back, whichever is earlier. The refund is made using the same means of payment as that used for the Order, unless the Customer agrees to another means, and at no cost to the Customer. The supplement paid for a delivery method more expensive than the standard method (for example, express) is not refunded. In the event of partial withdrawal, the initial delivery charges are refunded only if all Products in the Order are returned.

10.7. Exceptions. In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal does not apply in particular to:

  • Products made to the Customer's specifications or clearly personalised;
  • Products unsealed by the Customer after delivery which cannot be returned for reasons of hygiene or health protection (for example, certain cosmetics, underwear or earrings where their sealed packaging has been opened);
  • Products liable to deteriorate or expire rapidly.

These exceptions are indicated on the pages of the Products concerned.

Article 11: Legal guarantees and after-sales service

11.1. All Products benefit from the legal guarantee of conformity (Articles L217-3 et seq. of the French Consumer Code) and the legal guarantee against hidden defects (Articles 1641 to 1649 of the French Civil Code), which apply independently of any commercial guarantee.

11.2. Implementation. The Customer contacts customer service at contact@angelnomad.com, stating their Order number and describing the defect, with photos if possible. Angel Nomad tells them the procedure to follow and the return address. The costs of returning a non-conforming or defective Product are borne by Angel Nomad, which refunds them or provides a return label.

11.3. The guarantee does not cover defects resulting from normal wear and tear, an accident, misuse or care contrary to the Product's instructions.

11.4. Regulatory information on the legal guarantees (Article D211-2 of the French Consumer Code):

The consumer has a period of two years from delivery of the goods to obtain the implementation of the legal guarantee of conformity in the event of a lack of conformity appearing. During this period, the consumer is only required to establish the existence of the lack of conformity and not the date on which it appeared.

Where the contract for the sale of the goods provides for the continuous supply of digital content or a digital service over a period of more than two years, the legal guarantee applies to that digital content or digital service throughout the intended period of supply. During this period, the consumer is only required to establish the existence of the lack of conformity affecting the digital content or digital service and not the date on which it appeared.

The legal guarantee of conformity entails an obligation for the professional, where applicable, to provide all updates necessary to keep the goods in conformity.

The legal guarantee of conformity entitles the consumer to have the goods repaired or replaced within thirty days of their request, free of charge and without major inconvenience to them.

If the goods are repaired under the legal guarantee of conformity, the consumer benefits from a six-month extension of the initial guarantee.

If the consumer requests repair of the goods but the seller imposes replacement, the legal guarantee of conformity is renewed for a period of two years from the date of replacement of the goods.

The consumer may obtain a reduction in the purchase price while keeping the goods, or terminate the contract and obtain a full refund against return of the goods, if:

1° The professional refuses to repair or replace the goods;

2° The repair or replacement of the goods takes place after a period of thirty days;

3° The repair or replacement of the goods causes major inconvenience to the consumer, in particular where the consumer definitively bears the costs of taking back or removing the non-conforming goods, or bears the costs of installing the repaired or replacement goods;

4° The lack of conformity of the goods persists despite the seller's unsuccessful attempt to bring them into conformity.

The consumer is also entitled to a reduction in the price of the goods or to termination of the contract where the lack of conformity is so serious that it justifies an immediate price reduction or termination of the contract. The consumer is then not required to request repair or replacement of the goods first.

The consumer is not entitled to termination of the sale if the lack of conformity is minor.

Any period during which the goods are out of use for repair or replacement suspends the remaining guarantee period until the delivery of the goods restored to working order.

The rights mentioned above result from the application of Articles L. 217-1 to L. 217-32 of the French Consumer Code.

A seller who in bad faith obstructs the implementation of the legal guarantee of conformity is liable to a civil fine of up to 300,000 euros, which may be increased to 10% of average annual turnover (Article L. 241-5 of the French Consumer Code).

The consumer also benefits from the legal guarantee against hidden defects pursuant to Articles 1641 to 1649 of the French Civil Code, for a period of two years from the discovery of the defect. This guarantee entitles the consumer to a price reduction if the goods are kept or to a full refund against return of the goods.

Article 12: Liability and force majeure

12.1. Angel Nomad is responsible for the proper performance of its obligations. It cannot be held liable in the event of fault on the part of the Customer, an unforeseeable and insurmountable act of a third party, or force majeure.

12.2. Force majeure means any event beyond Angel Nomad's control which could not reasonably have been foreseen when the Order was placed and whose effects cannot be avoided by appropriate measures (Article 1218 of the French Civil Code), for example a carriers' strike, a natural disaster, a health crisis or a major network outage. Performance is then suspended; if the impediment lasts more than 30 days, either party may terminate the Order and the Customer is refunded the sums paid.

12.3. Angel Nomad is not responsible for third-party websites to which the Site links, nor for interruptions of the Site due to maintenance or external causes.

12.4. Nothing in these Terms limits the rights the Customer has under the law, in particular under the legal guarantees.

Article 13: Intellectual property

The texts, photographs, logos, graphic elements and other content of the Site are protected by intellectual property law. Any reproduction, representation or adaptation, in whole or in part, without prior written authorisation is prohibited. The brands of the Products sold belong to their respective owners.

Article 14: Personal data

The data collected when an Order is placed is processed by Brod'Styl International for the management of Orders, delivery, customer relations and, with the Customer's consent, marketing communications. The Customer has rights of access, rectification, erasure, objection, restriction and portability, which they may exercise at contact@angelnomad.com. Details of the processing are set out in the Privacy Policy.

Article 15: Customer service and complaints

For any question or complaint, customer service responds as soon as possible by e-mail at contact@angelnomad.com, by telephone on 01 41 33 41 55 (standard call rate), via the contact form, or by post at 41 rue du Caire, 75002 Paris, France. Any complaint must specify the Order number.

Article 16: Applicable law and disputes

16.1. These Terms are governed by French law. A Customer residing in another European Union country retains the protection of the mandatory provisions of the law of their country of residence.

16.2. In the event of a dispute, the Customer should first contact customer service to seek an amicable solution. Failing that, they may refer the matter, at their choice, to the court of the place where they resided at the time the contract was concluded or the damaging event occurred, or to any other court having jurisdiction under the law (Article R631-3 of the French Consumer Code).

Article 17: Evidence and archiving

The computerised records of the Site and its providers, kept under reasonable security conditions, constitute proof of Orders, communications and payments. For any Order of €120 or more including VAT, Angel Nomad keeps the written record of the contract for ten years and guarantees the Customer access to it on simple request (Articles L213-1 and D213-1 of the French Consumer Code).

Article 18: Miscellaneous provisions

18.1. If any clause of these Terms is declared null and void or unenforceable, the other clauses shall remain in force.

18.2. The fact that Angel Nomad does not invoke a clause at any given time does not constitute a waiver of its right to invoke it subsequently.
